Немецкая Uniper с помощью «хитрой» юридической тактики смогла получить компенсации после остановки поставок газа от «Газпрома», пишет Bloomberg.
Как и многие другие европейские энергокомпании — например итальянская Eni, французская Engie, австрийская OMV, — Uniper инициировала арбитражное разбирательство, подав иск к «Газпрому» на €11,6 млрд. Такие процессы обычно продолжаются годами, но Uniper смогла ускорить его, в то время как большинство все еще ждут выплаты.
Помимо арбитража летом 2022 года Uniper подала ходатайство о вынесении экстренного решения в земельный суд Вайдена в Баварии. Компания хотела получить €5 млрд аванса от «Газпрома», но инстанция отказала в выплатах, поэтому Uniper обратилась в Нюрнбергский суд. Тот встал на сторону компании и разрешил ей взыскать €3,65 млрд. Впоследствии Uniper выиграла еще два иска на €3,79 млрд и €576 млн, в результате общая сумма составила около €8 млрд.
Арбитражное разбирательство завершилось только в июне 2024-го, по его итогам немецкой компании присудили еще €13,5 млрд.
Адвокат по судебным спорам из франкфуртской юридической фирмы A&O Shearman Тино Шнайдер отметил, что примеру Uniper не могли последовать все европейские компании, реализовать такую тактику можно только при особых условиях: «Необходимо доказать наличие чрезвычайной ситуации. Существование Uniper было под угрозой. Не каждый кредитор соответствует этим требованиям».
Uniper начала получать выплаты в 2023 году, компания не стала уточнять, о какой сумме речь и какие именно требования были рассмотрены. Немецкая компания обязалась перевести правительству любые компенсации по иску к «Газпрому».
В марте 2024-го арбитражный суд Санкт-Петербурга и Ленинградской области обязал Uniper Global Commodities («дочку» Uniper) и METHA — Methanhandel выплатить €14,312 млрд «Газпром экспорту», следует из решения суда в картотеке дела. Решение было связано с нарушением судебного запрета, требовавшего от них прекратить разбирательство в международном арбитраже.
